Section 122's 10% expired — and new Section 301 forced-labor duties replaced it the same day
Two things happened at 12:01am ET on 2026-07-24, and most sources caught only the first. (1) The temporary Section 122 flat 10% expired by statute and is no longer collected. (2) USTR's final action in 60 forced-labor investigations took effect, adding 10% or 12.5% ad valorem on most goods in HTS Chapters 1-97 from 60 named economies. So for most origins the 10% did not go away — it was replaced by a duty of similar or larger size. Rates are additive for most countries (e.g. China, Vietnam, Brazil 12.5%; India, UK, Mexico 10%) and act as a floor for the EU, Japan, South Korea, Switzerland and Taiwan, meaning no extra duty if the base rate already meets the threshold. Section 232 articles, civil aircraft, pharmaceuticals, humanitarian donations, informational materials, USMCA-qualifying Canada/Mexico goods and CAFTA-DR textiles are exempt.
